A sample of ENC from the countries listed below has been looked at and differences have been identified that are navigationally significant. Whilst these differences are investigated, the UKHO advise that caution is exercised when navigating in these areas and recommends that ENCs in these areas are used in conjunction with a SOLAS compliant paper chart. Countries affected: Chile (CL) Mexico (MX) Pakistan (PK) Venezuela (VE) Please note that ENCs containing new objects depicting Archipelagic Sea Lanes, Environmentally Sensitive Sea Areas and Particularly Sensitive Sea Areas are now available within the Admiralty ENC Service, Admiralty ECDIS and AVCS, as specified in IHO S-57 (Edition 3.1.1). End Users will be able to view these new objects if their ECDIS is installed with the latest IHO Presentation Library – PL3.4. End Users with older versions of the Presentation Library (e.g. PL3.3 or earlier) will display these objects with a “?” (Question Mark). Users will still be able interrogate these objects to determine what they are. End Users with very old versions of the Presentation Library may not display them at all. BH (Bahrain) ENCs - Update Status ENC BH45006A has not been updated since introduced into service in August, 2005. Bahrain Outer buoy (26 21.4N, 50 42.4E) was removed from BA charts 2886, 3737, 3738 and 3790 by NM 1027/08 (week 9-28/02/08). Source: MENAS (Middle East Navigational Service). The buoy is still shown on ENC Approach 1:50k BH45006A. Mariners are warned that other discrepancies may exist on this chart. Bahrain are in the process of bringing the ENC up to date. Meanwhile, mariners are advised to exercise extreme caution when navigating on this chart. MX (Mexico) ENCs - Update Status Mexico do not currently implement an Update regime for their ENCs. Mariners are advised to use all MX ENCs with caution and refer to the appropriate paper chart coverage. VE (Venezuela) ENCs - Update Status Venezuela do not currently implement an Update regime for their ENCs. Mariners are advised to use all VE ENCs with caution and refer to the appropriate paper chart coverage. Republic of Korea have released a scheme of grid-based ENCs which have been included in Admiralty ENC services as of 24/07/08. The Republic of Korea chart-based ENCs have been removed from these services at the same time, although Republic of Korea will continue to issue and maintain them until the end of 2008. Republic of Korea was mistakenly allocated the KP Agency Code in early releases of IHO Document S-62; the new scheme carries the correct KR Agency Code. *************************************************************************************** This read-me text contains information pertaining to the supply of ENC and Admiralty Vector Charts in Admiralty services. GEOGRAPHICAL NAMES – UK GOVERNMENT POLICY Some of the chart data in this product have been compiled by other hydrographic offices. In accordance with principles adopted by the International Hydrographic Organization the UKHO has not, without the permission of the data producer, made any amendments to such data. Consequently some of the names used to depict geographical features do not reflect the policy of the United Kingdom in relation to the naming of such features. Where this is the case it in no way implies that the United Kingdom accepts that the geographical names used are appropriate, or that it approves of their use. Caution: Whilst the UKHO has made all reasonable efforts to ensure the data supplied is accurate, it should be appreciated that the data may not always be complete, up to date or positioned to modern surveying standards and therefore no warranty can be given as to its accuracy. However, currently-available ENCs do not contain such information and mariners using ENCs must continue to use related nautical publications. Therefore, mariners should satisfy themselves that their ECDIS provides all the navigational functionality that they will need and that they are familiar with the operation of this functionality. For example, some early ECDIS systems may be unable to display the cautionary notes which appear on the paper chart and are included in the ENC. Hence, care is required while experience is gained in the practical use of ECDIS. DATA APPEARANCE It should be noted that the appearance and content of Australian ENCS may differ substantially from the same or similar data in the paper chart form. In particular the compulsory pilotage routes in the Great Barrier Reef contain depth data at 1-metre contour intervals taken from original surveys rather than from the existing paper charts. This will enable the full benefits of ECDIS and particularly its safety depth alarm function to be used most effectively. See http://www.charts.gc.ca/pub/en/digitalchart/default.asp FI (FINLAND) According to the SOLAS convention (IMO Marine Safety Committee Resolution 99(73) which came into force July 1st 2002) this official Electronic Navigational Chart (ENC) produced by the Finnish Maritime Administration (FMA) can be used as a primary chart when there are no larger scale chart data available and the mariner is using a type approved ECDIS system. This ENC is based on paper charts and is published by the FMA. There are several ENCs available for the Finnish coast. For the latest ENC coverage of Finnish waters, please contact your local ENC distributor. Paper charts on a scale of 1:50000 are available for the Finnish coast. Additionally there are larger scale paper charts available for most important ports (Hamina (Finnish chart # 134), Kotka (# 138), Helsinki (# 191), Hanko (# 136), Turku (# 190), Maarianhamina (# 160), Degerby (# 169) and Mäntyluoto (# 225). In the table below you will find the paper equivalents of Finnish ENC cells according to their navigational purpose. IN (INDIA) Indian Electronic Navigational Chart Release 2007.000 The Indian National Hydrographic Office (INHO) Electronic Navigational Chart (ENC) Release 2007.000 is the first release by the National Hydrographic Office, India and is produced according to International Hydrographic Organization S57 Edition 3.1 standard and are intended for use while navigating in the area covered by this ENC on an IMO compliant ECDIS. The updates of the ENCs will be provided on CD-ROM on fortnightly basis. LICENCE AGREEMENT This is a legal agreement between you and the Indian National Hydrographic Office, India (INHO), relating to your use of "The Indian Electronic Navigational Charts (ENC Data). By purchasing the ENC Data and/or by using the ENC Data, you agree to be bound by this Agreement. TERM OF AGREEMENT - This Agreement shall commence from the date of purchase and continue for the subscription period of one year unless otherwise terminated under this Agreement. Upon expiry of the first year, you have to renew your subscription for another year at such rates and on such terms and conditions to be determined by INHO at the date of renewal. PAYMENT - In consideration of the grant of the license and the services provided below, you agree to pay NHO/the Distributor the full purchase price of the ENC Data. UPDATED - Updates will be sent to you to keep you informed of the changes made to the ENC Data. In order to receive the updates, you must register with the authorized distributor(s). GRANT OF LICENSE - INHO grants you a non-exclusive license to use one copy of the ENC Data, which is licensed as a single product. The ENC Data is "in use" when it is loaded into the temporary memory (i.e. RAM) or installed into the permanent memory (e.g. hard disk, CD-ROM or other storage device) of a computer. COPYRIGHT - The ENC Data is owned by INHO and is protected by Government of India copyright laws, international treaty provisions, and all other applicable national laws. INHO reserves all rights not expressly granted. You may not rent, lease, market, distribute or transfer the ENC Data in part or full or any such copies to others or electronically transfer the ENC Data over a network. You may not reverse engineer, de-compile, disassemble or otherwise reduce the ENC Data to a human perceivable form for distribution to any third party. You may not modify, adapt the ENC Data or create derivative works based on the ENC Data or the accompanying written materials. Except where permitted under this License, the reproduction of the entire data comprised in the ENC Data in any form is expressly forbidden. You may be held legally responsible for any copyright infringement, which is caused or encouraged by your failure to abide by the terms of this License. You may not copy the accompanying written materials. VARIATION OF TERMS - INHO reserves the right to vary, alter or modify these terms and conditions from time to time and every renewal of subscription shall be subject to the new terms as may be varied, altered or modified at the date of renewal. LIMITED WARRANTY - INHO warrants that the ENC Data will perform substantially in accordance with the accompanying written materials for the period of license from the date of receipt when properly installed on an IMO compliant ECDIS. INHO does not warrant that the operation of the ENC Data will meet your requirements or operate free from error. INHO disclaims all other warranties, either express or implied, including but not limited to implied warranties or merchantability and fitness for a particular purpose or the accuracy of the contents, with respect to the ENC Data and the accompanying written materials. CUSTOMER REMEDIES - INHO's entire liability and your exclusive remedy shall be, at INHO's sole discretion, either the refund of the purchase price paid or the replacement of the ENC Data that does not meet INHO's limited warranty, upon the return of the ENC Data to INHO with a copy of your receipt within the warranty period. The limited warranty is void if failure of the ENC Data has resulted from accident, abuse or misapplication. Any replacement ENC Data will be warranted for the remainder of the original warranty period or 30 days, whichever is longer. NO LIABILITY FOR CONSEQUENTIAL DAMAGE - In no event shall INHO or its suppliers be liable for any damage whatsoever (including, without limitation, indirect, special, incidental, economic or consequential damages) arising out of the use of or inability to use the ENC Data or reliance on the ENC Data, even if NHO has been advised of the possibility of such damage. In any case, INHO's entire liability whether under this Agreement or in tort (including negligence), product liability or otherwise shall be limited to the amount actually paid by you. TERMINATION - This Agreement shall continue in force until terminated in any of the following ways : (a) destruction of the ENC Data; (b) automatically if you fail to comply with any term or condition of this Agreement; and (c) upon expiry of the subscription period or any renewal thereof. Upon such termination, you agree to return the ENC Data to INHO. The right of termination shall be in addition to any other remedies available to INHO. GENERAL - This Agreement shall be governed and interpreted in accordance with the laws of the Republic of INDIA. US (UNITED STATES OF AMERICA) Only ENCs named using the 'US' prefix are produced by the United States' National Oceanic and Atmospheric Administration (NOAA). NOAA ENCs are provided within this service under the provision of Certified ENC Distributor (CED) status, and therefore when maintained up to date meet US Federal carriage requirements. US ENCs are an official product produced by NOAA. They may be used to meet federal chart carriage regulations published in the Code of Federal Regulations. On November 15, 2005, the regulations were as stated below. These regulations may change, and mariners are advised to check the Code of Federal Regulations for their current status. 1) On May 2, 2001, the United States Coast Guard amended the United States chart carriage regulations to permit government vessels to use electronic charting and navigation systems in lieu of paper charts. 2) On July 1, 2002, the International Maritime Organization's (IMO) amendments to chapter V of the International Convention for the Safety of Life at Sea (SOLAS) became effective after being accepted by the Contracting Governments to SOLAS (Jan 2002) and the IMOs Maritime Safety Committee (Dec 2000). These amendments, in part, allowed an electronic chart display system (ECDIS) using ENCs to be accepted as meeting chart carriage requirements of SOLAS chapter V. 3) On August 15, 2002, the United States Coast Guard issued a statement of policy to bring its regulations into agreement with SOLAS Chapter V (as amended by the changes taking effect July 1, 2002). The policy statement said that, if a ship has an approved ECDIS installed according to SOLAS, Chapter V, the ECDIS will be considered as meeting the ship's nautical chart carriage regulations. The ships that are affected are: a) U.S.-flagged ships of 150 or more gross tons that engage on international voyages. b) U.S.-flagged ships certificated solely for service on the Great Lakes and the St. Lawrence River. c) Foreign-flag ships to which SOLAS, Chapter V, applies that are operating on the navigable waters of the United States. This policy is not applicable to U.S.-flag ships engaged only on domestic voyages. These ships must continue to comply with existing navigation equipment requirements until the chart carriage regulations are formally amended. NOAA updates its ENCs for Notice to Mariners on a weekly basis, but the timing of their availability is not guaranteed. Mariners are responsible for ensuring that their ENCs are the most current edition and that the most recent updates have been applied. While NOAA has accuracy standards for each step in the data collection and chart production process, much of the depth information found on NOAA charts is based on surveys conducted before 1940, the shoreline is more than 20 years old, and paper charts used to be compiled manually. The mariner is warned that certain US ENCs have duplicate TXTDSC filenames, but with different contents. This may have varying results, depending on the ECDIS on which they are displayed. In some circumstances, the ENCs will have the correct versions of TXTDSC files associated with them as they are linked, but on ECDIS that store only one current version of a TXTDSC, a different version than the one intended may be displayed. Most differences are of a minor nature and will not cause any problems, but some will cause erroneous information to be attributed to ENCs. This includes a variety of information including US Coast Pilot details, COLREGS and other cautionary information. NOAA are in the process of issuing New Editions to rectify the problems. CANADIAN ENCs - Canadian Textual Description (TXTDSC) files are rendered in HTML (.htm) format. NATIONAL LANGUAGE ATTRIBUTES There are five National Language Attributes which are defined in S-57, the ENC Tranfer Standard. These are all string type attributes intended to hold text in a national language. It has come to our attention that some national languages, especially those that use additional character sets, e.g. Turkish, Korean, etc. cannot be viewed in some ECDIS equipment. In these instance reference should be made to the English language versions of these files or references. The National Language Attributes affected are as follows and may be referenced from within the ECDIS with an unreadable text string: NINFOM [Information in national language] NOBJNM [Object name in national language] NPLDST [Pilot district in national language] $NTXST [Text string in national language] NTXTDS [Textual description in national language] In the case NTXTDS [Textual description in national language] files, it may be the content of the text file that is unreadable.
