A revised NAVAREA 1 warning (317/10) was issued on 30 October 2010 (see below). Some of this anomalous behaviour appears to relate to software implementation issues, especially in early ECDIS models. In addition to reminding mariners not to rely solely on the automated checks and alarms for dangers provided by ECDIS during route planning and voyage monitoring, the NAVAREA warning highlights the need to maintain ECDIS software to ensure any limitations in operational capability are resolved. It recommends that appropriate checks are made with equipment manufacturers, especially where the ENC display is the only source of chart information available. Examples of anomalous behaviour: 1. A very small proportion of shoal soundings, especially those marked as “reported” on paper charts, are not visible when operating in the default base or standard display modes and do not trigger automatic grounding alarms in route checking or monitoring modes. Most ENC producers, including the UKHO, have now amended the way in which these particular shoal soundings have been encoded in S-57 to resolve this issue. 2. Some ECDIS may not activate alarms for all land areas shown on ENCs, even where these are surrounded by a shoal depth contour. Whilst land areas such as islands are generally clearly identifiable on ECDIS, in some display configurations small islands can be difficult to see as they may be obscured by other detail such as contour labels. This is most likely to be a problem where only very small scale (usage band 1 and 2) ENCs are available. There are many oceanic areas for which the largest scale chart (both paper and ENC) issued is 1:3.5 million. 3. It has been noted that on some ECDIS some underwater obstruction hazards only display in ‘full / other’ display mode rather then in default standard mode as might be expected. The observed anomalies reinforce the need for the continued application of established navigation principles and skills including the need to avoid over-reliance on a single system. Mariners should always undertake careful visual inspection of the entire planned route using the ‘other / all’ display mode to confirm that it, and any deviations from it, is clear of dangers. NAVAREA I WARNING 317/10 ------------------------ As previously notified by NAVAREA warning, mariners using ECDIS are reminded not to rely solely on automated voyage planning and monitoring checks and alarms. Some ECDIS appear only to undertake route check functions on larger scale ENCs and therefore alarms might not activate. This may not be clearly indicated on the ECDIS display. Mariners should always undertake careful visual inspection of the entire planned route using the ‘other / all’ display mode to confirm that it, and any deviations from it, is clear of dangers. Recent preliminary investigation indicates that some ECDIS may not display certain combinations of chart features and attributes correctly and on rare occasions may fail to display a navigationally significant feature. This appears to be caused by anomalous behaviour in some ECDIS software, especially early versions. The existence of such anomalies highlights the importance of maintaining ECDIS software to ensure that operational capability and reliability are maintained. It is recommended that appropriate checks are made with the equipment manufacturer. This is of particular importance where ECDIS is the only source of chart information available to the mariner. The International Hydrographic Organization (IHO) is investigating these matters in consultation with ECDIS equipment manufacturers. Further information will be made available through Notices to Mariners and within the UK element of the README.TXT file included on ENC service media. Cancels Warning 230/10. OVERLAPPING CELLS IN THE SAME USAGE BAND: ----------------------------------------- Some data providers issue ENCs which contain overlapping data coverage, both internally and with adjoining nation’s coverage. This may make them difficult to use in certain ECDIS systems which default to displaying both overlapping cells. Caution should therefore be exercised when using such overlapping data. Mariners should be aware that there will be a possibility that items of significance may be present only in one data set within an area of overlap. They should therefore take care to examine both data sets when planning a voyage through such an area. Some overlaps may be quite small and may not be noticeable when viewing data at the appropriate scale. Discussions are in hand between many of the data producers in order to resolve overlapping data problems. ENCs DERIVED FROM CHARTS ON NON-WGS84 COMPATIBLE DATUMS: -------------------------------------------------------- Positions obtained from Global Navigation Satellite Systems, such as GPS, are normally referred to WGS84 Datum. In many parts of the world, however, charts were originally produced on a variety of local datums for which the shift to WGS84 may be unknown or unreliable. ENCs derived from such charts may not be accurately referred to WGS84 Datum. This can result in small but noticeable positional differences where adjoining cells have been shifted by slightly different amounts. A number of Indonesia (ID) and Great Britain (GB) ENC's are derived from charts that cannot be accurately referred to WGS84 Datum. The differences between satellite-derived positions and positions on these cells cannot be accurately determined; the estimated values of the differences for these cells are detailed in the Information attribute of Caution Areas thus: "Positions in this region lie within ± nn metres of WGS84 Datum". Mariners are warned that these differences MAY BE SIGNIFICANT TO NAVIGATION and are therefore advised to confirm GPS positions shown in the chart display using alternative navigational techniques, particularly when closing the shore or navigating in the vicinity of dangers. Such cells contain a warning encoded as the name of a Sea Area feature covering the cell thus: "This chart cannot be accurately referenced to WGS84 Datum; see caution message". They are intended for use with this warning continuously displayed and should not be used otherwise. UPDATING OF ENCs IN LINE WITH PAPER CHARTS: ------------------------------------------- The UKHO's weekly updating service for ENCs includes the latest updates issued by all the contributing Hydrographic Offices. These updates may or may not be synchronised with Notices to Mariners and New Editions produced for their national paper chart series. In some cases, therefore, ENCs may be less up to date than the corresponding paper chart of the same area. Practice also varies between different Hydrographic Offices with regard to the updating of ENCs for Temporary (T) and Preliminary (P) Notices to Mariners. Several ENC producers include T&P NMs in their cells wherever possible, but where this is not the case Mariners are advised to consult relevant T&P NMs published in Notices to Mariners bulletins or on the ENC producer's website (if available). The attributes Date Start (DATSTA) and Date End (DATEND) are used by UKHO and some other Hydrographic Offices to notify mariners in advance of major changes such as the introduction of new or amended routeing measures. The purpose of these attributes is to allow mariners to preview forthcoming changes and for the ECDIS to apply the changes automatically at the appropriate time. ECDIS approved to IEC 61174 Edition 2 (2002) or later should be able to display the time-related features correctly. However, ECDIS approved prior to IEC 61174 Edition 2 may display both old and new routeing measures simultaneously or fail to give any indication of the changes. Further information about the update status of ENCs from specific countries is included in Sections 2 and 4. CHART DISPLAY CONTENT: ---------------------- Mariners should be aware that the appearance and content of the data displayed in electronic charts may differ substantially from the same or similar data in paper chart form. The ECDIS chart display is generated "on-the-fly" according to display rules defined by the IHO Presentation Library. The amount of detail that is displayed will depend on a number of factors, including: - The cells loaded on the ECDIS and available for display. - The feature content of those cells (including any objects with date, time or scale dependent attributes). - The display scale set by the ECDIS user. - The display mode set by the ECDIS user (i.e. "Base", "Standard" or "All"). - The Safety Contour, Safety Depth and Safety Height set by the ECDIS user. - Other user display options provided by the ECDIS (e.g. options to show isolated dangers in shallow waters, full length light sectors, etc). - The ECDIS manufacturer's implementation of the IHO Presentation Library. SCREEN CLUTTER: --------------- Each object in an ENC may be given a Scale Minimum (SCAMIN) value. This determines the display scale below which the object must no longer be displayed by an ECDIS and can be a valuable tool in reducing clutter on the screen. The International Hydrographic Organization (IHO) has recommended best practice for setting SCAMIN, which has been accepted by the majority of Hydrographic Offices, although this may take some time to implement. In the meantime, mariners are advised to exercise caution when operating in reduced display modes. Generally speaking, screen clutter is not a problem when navigating at or near the stated compilation scale of a cell. S-57 EDITION 3.1.1 - NEW OBJECTS: --------------------------------- ENCs containing new objects depicting Archipelagic Sea Lanes, Environmentally Sensitive Sea Areas and Particularly Sensitive Sea Areas are now available within the Admiralty ENC Services, as specified in IHO S-57 (Edition 3.1.1). End Users will be able to view these new objects if their ECDIS is installed with the latest IHO Presentation Library – PL3.4. End Users with older versions of the Presentation Library (e.g. PL3.3 or earlier) will display these objects with a "?" (Question Mark). Users will still be able interrogate these objects to determine what they are. End Users with very old versions of the Presentation Library may not display them at all. NATIONAL LANGUAGE ATTRIBUTES: ----------------------------- Four National Language Attributes are defined in S-57 for use in ENCs. These are all string type attributes intended to hold text in a national language. It has come to our attention that some national languages, especially those that use additional character sets, e.g. Turkish, Korean, etc. cannot be viewed in some ECDIS equipment. In these instances reference should be made to the English language versions of these files or references. The National Language Attributes affected are as follows and may be referenced from within the ECDIS with an unreadable text string: NINFOM [Information in national language] NOBJNM [Object name in national language] NPLDST [Pilot district in national language] NTXTDS [Textual description in national language] In the case of NTXTDS [Textual description in national language] files, it may be the content of the text file that is unreadable. WITHDRAWAL OF ENCs FROM ADMIRALTY SERVICES: ------------------------------------------- "Cancellation" is the term used when an ENC producer issues an update to cancel and delete a base cell. Since an ENC can only be updated by the ENC producer, it follows that an ENC can only be cancelled by the ENC producer. "Withdrawal" is the term used when the UKHO decides to withdraw an ENC from Admiralty ENC services, since the UKHO is unable to "cancel" an ENC from another ENC producer. The key distinction is that if an ENC is withdrawn, there is nothing to prevent end users continuing to use the cell until their permit expires. While cells remain withdrawn they will not be updated and their carriage will not satisfy SOLAS requirements. Mariners are therefore recommended to remove these cells from ECDIS or ECS systems onto which they have been loaded. Details of withdrawn ENCs are included in Section 3. ************************************************************************************************************************************************************* SECTION 2: SPECIFIC CAUTIONS ************************************************************************************************************************************************************* C1 (CHINA NGD) - IMPORTANT INFORMATION IN SECTION 1 NOTICES TO MARINERS ----------------------------------------------------------------------- Mariners should be aware that the Navigation Guarantee Department (NGD) of the Chinese Navy Headquarters announce navigational information within Section 1 of their Weekly Notices to Mariners publication. This information is not intended to correct NGD products but may be significant to navigation. NGD (C1) ENCs are not updated for this information, which may include changes to routeing measures and port developments. CA (CANADA) ENCs – TXTDSC FILES IN HTML FORMAT: ----------------------------------------------- When notes or cautions are encoded using the Textual Description (TXTDSC) attribute, the associated text file is normally expected to be a plain ASCII text file with a .txt file extension. Some Canadian TXTDSC files, however, are rendered in HTML format with a .htm extension. Although some ECDIS/ECS are able to handle this type of file, many do not. In some cases, the files may be viewable but not easily readable as they contain the HTML tags; in other cases the files may simply fail to load (with or without a warning message). Currently less than 20 ENCs are affected and Canada are in the process of replacing their HTML files with plain text files. GR(Greece) / TR(Turkey) ----------------------- Some Greek and Turkish ENCs contain overlapping data coverage which may make them difficult to use in certain ECDIS systems which default to displaying both overlapping cells. Caution should therefore be exercised when using such overlapping data. Discussions are in hand between the relevant hydrographic offices in order to resolve this overlapping data problem. In the meantime, the affected ENC cells are as follows: Greek ENC(s) Turkish ENC(s) GR2AF7UH TR200029, TR200032 GR3CFMB4, GR3CFHV4 TR300312 GR3CFHV4, GR3CFHV8 TR300313 GR3CFHV8 TR300321 GR3CFQQS, GR3CFQQW, GR3CFQR0 TR300223 GR3CFV6W TR300221 GR4APP01 TR402144, TR402145, TR402146, TR402147 GR4APP05 TR402111, TR402134, GR4APP07 TR403211 GR4APP08 TR402231 GR4APP15 TR402210, TR402223, TR402224 JP (JAPAN) ENCs - PILOT BOARDING PLACES: ---------------------------------------- Pilot boarding places are only shown on Japan Hydrographic and Oceanographic Department (JHOD) products at scales larger than 1:100,000 and then only when the Japan Pilot Association, who decide the position of them, wish to show them. The Japan Pilot Association instructs JHOD not to show them in Seto Nai Kai (Inland Sea). US (UNITED STATES OF AMERICA) ENCs – TXTDSC FILENAMES: ------------------------------------------------------ Problems with Textual Description (TXTDSC) file contents. Mariners are warned that certain US ENCs have duplicate TXTDSC filenames, but with different contents. This may have varying results, depending on the ECDIS on which they are displayed. In some circumstances, the ENCs will have the correct versions of TXTDSC files associated with them as they are linked, but on ECDIS that store only one current version of a TXTDSC, a different version than the one intended may be displayed. Most differences are of a minor nature and will not cause any problems, but some will cause erroneous information to be attributed to ENCs. This includes a variety of information including US Coast Pilot details, COLREGS and other cautionary information. NOAA are in the process of issuing New Editions to rectify the problems. ************************************************************************************************************************************************************* SECTION 3: WITHDRAWN ENC CELLS THAT ARE NO LONGER AVAILABLE OR MAINTAINED ************************************************************************************************************************************************************* C1 (CHINA) ENC's: ----------------- The UKHO has withdrawn the following 2 Chinese cells because they contain data that is navigationally, significantly different to that contained in smaller scale Chinese ENCs. C1611882 C1615372 MX (MEXICO) ENCs: ----------------- Mexico has recently implemented an Updating regime for their ENCs. Mariners are advised to use the MX ENCs listed below with caution and refer to the appropriate paper chart coverage as these are yet to be Updated. These ENCs are currently withdrawn from service; see IC-ENC disclaimer in Section 5. MX200900 MX308212 MY (MALAYSIA) ENCs: ------------------- Malaysian cells MY3C0521 and MY3C0532 overlap cells issued by Malacca & Singapore Straits group (MS). The Malaysian authority has agreed for us to temporarily remove the cells which overlapped with the MSS consortium ones. VE (VENEZUELA) ENCs: -------------------- Venezuela do not currently implement an Update regime for their ENCs. Mariners are advised to use all VE ENCs with caution and refer to the appropriate paper chart coverage. These ENCs are currently withdrawn from service; see IC-ENC disclaimer in Section 5. VE300100 VE300200 VE300300 VE300400 VE300500 VE300600 VE301000 VE400102 VE400201 VE400304 VE400402 VE400408 VE400410 VE400505 VE401002 VE401003 VE401004 VE500104 VE500105 VE500106 VE500202 VE500302 VE500308 VE500315 VE500405 VE500406 VE500407 VE500411 VE500501 VE500502 VE500504 VE500511 VE500603 VE501301 VE501302 VE501401 VE501402 ************************************************************************************************************************************************************* SECTION 4: ADMIRALTY INFORMATION OVERLAY ************************************************************************************************************************************************************* OVERLAY CONTENT --------------- The Admiralty Information Overlay contains all Admiralty Temporary & Preliminary Notices to Mariners (T&P NMs) and provides additional preliminary information that is specific to ENCs, such as reported navigational hazards that are not yet charted. The Overlay gives seafarers an easy way to view the information they need, in addition to the standard chart, to navigate safely and compliantly. The Overlay makes passage planning simpler and safer by clearly showing where important Temporary or Preliminary changes may impact a voyage. It also gives seafarers the same consistent picture of the maritime environment on their ECDIS as they have always had with the Admiralty paper chart. The Overlay includes all Admiralty T&P NMs in force worldwide and additional information that relates specifically to ENCs, published as ENC Preliminary NMs (EP NMs). The UKHO includes information in the Overlay where it exists in the UKHO archive of hydrographic information. Some ENCs produced by national Hydrographic Offices are the equivalent to their local paper chart series and there is no equivalent Admiralty paper chart. In these areas the UKHO does not have any additional information and the Overlay shows a ‘No Overlay’ feature. Additional information, such as local T&P NMs, may be available in these areas from other sources and seafarers should ensure that all appropriate sources of information have been consulted. OVERLAY AVAILABILITY -------------------- The Admiralty Information Overlay is available, free of additional charge, to all users of AVCS and the Admiralty ECDIS who have compatible display equipment (see below). Please contact your Admiralty Chart Agent to add the Overlay to your AVCS or Admiralty ECDIS Service licence. COMPATIBLE EQUIPMENT -------------------- The Overlay can be displayed on compatible ECDIS equipment and also in Admiralty e-Navigator Planning Station. Please see the UKHO website at www.ukho.gov.uk/AVCS for an up to date list of compatible equipment, or consult your ECDIS supplier. Most ECDIS equipment installed prior to 2011 will require an upgrade before it will be able to display the Overlay. UPDATING -------- Updates to the Admiralty Information Overlay are issued weekly on CD, along with the weekly AVCS Update CD, and should be loaded by the user in the same way as loading ENC updates. Each CD is labelled with the week number and date of its issue and the most recent CD is always the most up to date – all others can be discarded. Users of Admiralty e-Navigator Planning Station may also download Overlay updates over the Internet. However it is necessary to issue a New Edition of the Overlay every 6 months, which consolidates all update data into a base data set, that may be over a hundred megabytes in size. It is impractical for most users to download this volume of data over the Internet and an Admiralty Information Overlay CD should be used. ************************************************************************************************************************************************************* SECTION 5: ENC SUPPLIERS' INFORMATION ************************************************************************************************************************************************************* COMMON INFORMATION: ------------------- DEVELOPMENT AND USE OF ECDIS ---------------------------- Considerable progress has been made in the development of Electronic Chart Display and Information Systems (ECDIS), the navigational systems which make use of ENC data. Many are being developed and a number have now achieved type approval. Mariners should be aware of the significant changes in navigational practice required by the introduction of ECDIS and of the need to manage these changes in a careful and prudent manner. In particular, he should recognise the developing nature of ECDIS and its supporting services, the user-training requirement, and the need for adequate back up arrangements. It should also be noted that the appearance and content of the data displayed in electronic charts may differ substantially from the same or similar data in the paper chart form. The definition of an ENC permits them to include information contained in nautical publications. However, currently-available ENCs do not contain such information and mariners using ENCs must continue to use related Admiralty nautical publications. Although ECDIS has been in use at sea for some years, its employment is not yet widespread and many mariners remain unpractised in its use. Mariners must therefore be aware of the user training requirement. They should satisfy themselves that their ECDIS provides all the navigational functionality that they will need and that they are familiar with the operation of this functionality. For example, some early ECDIS systems may be unable to display the cautionary notes which appear on the paper chart and are included in the ENC. Hence, care is required while experience is gained in the practical use of ECDIS. Some national maritime administrations have issued advice relating to the introduction of ECDIS, and mariners should ensure that they are aware of, and conversant with, that advice. RENC INFORMATION: ----------------- IC-ENC DISCLAIMER TEXT ----------------------- IC-ENC has made all reasonable efforts to ensure that ENC data contained in the service supplied under this agreement is accurate. The ENC data is supplied by national Hydrographic Offices, which are responsible for the accuracy of their own chart information. Moreover, IC-ENC shall not be liable (except in case of death or personal injury solely and directly attributable to any negligent compilation or transcription by IC-ENC) in contract, tort, under statute or otherwise. PRIMAR DISCLAIMER TEXT ----------------------- PRIMAR has made all reasonable efforts to ensure that ENC data contained in the service supplied under this agreement is accurate. The ENC data is supplied by national Hydrographic Offices, which are responsible for the accuracy of their own chart information. Moreover, PRIMAR shall not be liable (except in case of death or personal injury solely and directly attributable to any negligent compilation or transcription by PRIMAR) in contract, tort, under statute or otherwise. The ENCs contained in the PRIMAR service meet SOLAS chart and carriage requirements when kept up to date and used on an ECDIS with suitable backup. ENC PRODUCER´S INFORMATION: --------------------------- AU (AUSTRALIA) -------------- UPDATES Updates for Australian ENCs are issued in line with the fortnightly Australian Notices to Mariners booklet. ENC updates are issued for all Permanent Notices to Mariners. For details of Temporary and Preliminary Notices to Mariners, mariners should consult the fortnightly Australian Notices to Mariners available via the AHS website at www.hydro.gov.au or register online at the AHS website to receive eNotices, an email Notices to Mariners service. DATA APPEARANCE It should be noted that the appearance and content of Australian ENCS may differ substantially from the same or similar data in the paper chart form. In particular the compulsory pilotage routes in the Great Barrier Reef contain depth data at 1-metre contour intervals taken from original surveys rather than from the existing paper charts. This will enable the full benefits of ECDIS and particularly its safety depth alarm function to be used most effectively. IMPORTANT NOTICE Australian ENCs include all significant hydrographic information obtained by the Australian Hydrographic Service (AHS) at date of compilation. Significant information is updated by Australian Notices to Mariners. All reasonable efforts have been made to ensure the accuracy and completeness of the information, including third party information, incorporated in this product. The AHS regards third parties from which it receives information as reliable, however the AHS cannot verify all such information and errors may therefore exist. Where possible, indications regarding the reliability of information are noted or symbolised in the product. Users should familiarise themselves with the meaning of any notes or symbols. The AHS does not accept liability for errors in third party information or the inappropriate use of Australian ENCs. FI (FINLAND) ------------ According to the SOLAS convention (IMO Marine Safety Committee Resolution 99(73) which came into force July 1st 2002) this official Electronic Navigational Chart (ENC) produced by the Finnish Maritime Administration (FMA) can be used as a primary chart when there are no larger scale chart data available and the mariner is using a type approved ECDIS system. This ENC is based on paper charts and is published by the FMA. There are several ENCs available for the Finnish coast. For the latest ENC coverage of Finnish waters, please contact your local ENC distributor. Paper charts on a scale of 1:50000 are available for the Finnish coast. Additionally there are larger scale paper charts available for most important ports (Hamina (Finnish chart # 134), Kotka (# 138), Helsinki (# 191), Hanko (# 136), Turku (# 190), Maarianhamina (# 160), Degerby (# 169) and Mäntyluoto (# 225). In the table below you will find the paper equivalents of Finnish ENC cells according to their navigational purpose. According to IHO standard S-57, which determines the data content and technical implementation of ENC cells, the depth of a channel can be expressed with one decimal digit only. Therefore ENC cells show the maximum authorised draught of the route as 4.3m although the actual draught is 4.35m. GB (GREAT BRITAIN) ------------------ Attention is drawn to the statement in Chapter 1, sections 1.24 to 1.27 of The Mariners Handbook (NP100) concerning the use of navigational information provided by the UKHO. This includes the following caution which applies to all charts, paper and electronic: Whilst the UKHO has made all reasonable efforts to ensure the data supplied is accurate, it should be appreciated that the data may not always be complete, up to date or positioned to modern surveying standards and therefore no warranty can be given as to its accuracy. The Mariner must be the final judge of the reliance he places on the information given, bearing in mind his particular circumstances, the needs of safe and prudent navigation, local pilotage guidance and the judicious use of available navigational aids. The appearance and content of the data depicted on paper and digital charts may vary with the scale of the chart and may be different when depicted in a digital chart system. Sections 2.77 to 2.97 of The Mariner's Handbook (NP100) provides further detailed information about the use of electronic charts and display systems. Updates for UKHO ENCs are issued weekly in line with UKHO policy for all its navigational charts, paper and electronic. Due to unforeseen technical difficulties, ENC updates may occasionally be issued late and consequently may not be synchronised with the corresponding Notices to Mariners and updates for paper and ARCS charts. Updates are issued for all Permanent Chart-Correcting and Preliminary Notices to Mariners. However, it may not always be possible to issue updates for Temporary Notices to Mariners, especially those that cover large geographical areas and are not chart specific. Mariners should consult the paper weekly Notices to Mariners booklet or the UKHO website, www.nms.ukho.gov.uk, for details of these Notices to Mariners. INTERIM CATEGORY OF ZONE OF CONFIDENCE IN DATA (CATZOC) VALUES The boundaries between Quality of Data (M_QUAL) areas with different CATZOC values for certain cells have been taken from the Source Data Diagram (SDD) on the equivalent paper chart and they should therefore be considered to be approximate. Where this is applicable the Information attribute (INFORM) for the M_QUAL area will be set to: “Zone of Confidence data is taken from charted source data diagrams and so is approximate and simplified. See the README.TXT file contained in the ENC_ROOT folder on any Base or Update CD for further details.” For these M_QUAL areas, the CATZOC values are based on the simplified summary provided in the SDD and therefore represent the lowest categorisation assigned to any survey in each defined group of surveys. The degree of simplification also means that it has not been possible to identify minor gaps within survey coverage and mariners should be aware that such gaps (where lower quality survey data has been used in the compilation of the chart) may exist. Adjoining areas within the SDD that require the same CATZOC value have been joined together into a single area. Note that these assessments are based on original survey accuracies and on expectations of good practice by relevant survey authorities. It is to be expected that some evaluations may require downgrading once detailed survey information has been examined. CATEGORY OF ZONE OF CONFIDENCE IN DATA (CATZOC) VALUES - SMALL SCALE CHARTS Some ENCs are based on small scale planning charts that do not have a Source Data Diagram. The UKHO has adopted a policy of allocating a CATZOC value of ‘D’ to all Quality of Data (M_QUAL) areas of such charts though it recognizes that many of these areas are based on higher quality data. All interim CATZOC values will be replaced by definitive ones in due course. IN (INDIA) ---------- Indian Electronic Navigational Chart Release 2007.000 The Indian National Hydrographic Office (INHO) Electronic Navigational Chart (ENC) Release 2007.000 is the first release by the National Hydrographic Office, India and is produced according to International Hydrographic Organization S57 Edition 3.1 standard and are intended for use while navigating in the area covered by this ENC on an IMO compliant ECDIS. The updates of the ENCs will be provided on CD-ROM on fortnightly basis. LICENCE AGREEMENT This is a legal agreement between you and the Indian National Hydrographic Office, India (INHO), relating to your use of "The Indian Electronic Navigational Charts (ENC Data). By purchasing the ENC Data and/or by using the ENC Data, you agree to be bound by this Agreement. TERM OF AGREEMENT - This Agreement shall commence from the date of purchase and continue for the subscription period of one year unless otherwise terminated under this Agreement. Upon expiry of the first year, you have to renew your subscription for another year at such rates and on such terms and conditions to be determined by INHO at the date of renewal. PAYMENT - In consideration of the grant of the license and the services provided below, you agree to pay NHO/the Distributor the full purchase price of the ENC Data. UPDATED - Updates will be sent to you to keep you informed of the changes made to the ENC Data. In order to receive the updates, you must register with the authorized distributor(s). GRANT OF LICENSE - INHO grants you a non-exclusive license to use one copy of the ENC Data, which is licensed as a single product. The ENC Data is "in use" when it is loaded into the temporary memory (i.e. RAM) or installed into the permanent memory (e.g. hard disk, CD-ROM or other storage device) of a computer. COPYRIGHT - The ENC Data is owned by INHO and is protected by Government of India copyright laws, international treaty provisions, and all other applicable national laws. INHO reserves all rights not expressly granted. You may not rent, lease, market, distribute or transfer the ENC Data in part or full or any such copies to others or electronically transfer the ENC Data over a network. You may not reverse engineer, de-compile, disassemble or otherwise reduce the ENC Data to a human perceivable form for distribution to any third party. You may not modify, adapt the ENC Data or create derivative works based on the ENC Data or the accompanying written materials. Except where permitted under this License, the reproduction of the entire data comprised in the ENC Data in any form is expressly forbidden. You may be held legally responsible for any copyright infringement, which is caused or encouraged by your failure to abide by the terms of this License. You may not copy the accompanying written materials. VARIATION OF TERMS - INHO reserves the right to vary, alter or modify these terms and conditions from time to time and every renewal of subscription shall be subject to the new terms as may be varied, altered or modified at the date of renewal. LIMITED WARRANTY - INHO warrants that the ENC Data will perform substantially in accordance with the accompanying written materials for the period of license from the date of receipt when properly installed on an IMO compliant ECDIS. INHO does not warrant that the operation of the ENC Data will meet your requirements or operate free from error. INHO disclaims all other warranties, either express or implied, including but not limited to implied warranties or merchantability and fitness for a particular purpose or the accuracy of the contents, with respect to the ENC Data and the accompanying written materials. CUSTOMER REMEDIES - INHO's entire liability and your exclusive remedy shall be, at INHO's sole discretion, either the refund of the purchase price paid or the replacement of the ENC Data that does not meet INHO's limited warranty, upon the return of the ENC Data to INHO with a copy of your receipt within the warranty period. The limited warranty is void if failure of the ENC Data has resulted from accident, abuse or misapplication. Any replacement ENC Data will be warranted for the remainder of the original warranty period or 30 days, whichever is longer. NO LIABILITY FOR CONSEQUENTIAL DAMAGE - In no event shall INHO or its suppliers be liable for any damage whatsoever (including, without limitation, indirect, special, incidental, economic or consequential damages) arising out of the use of or inability to use the ENC Data or reliance on the ENC Data, even if NHO has been advised of the possibility of such damage. In any case, INHO's entire liability whether under this Agreement or in tort (including negligence), product liability or otherwise shall be limited to the amount actually paid by you. TERMINATION - This Agreement shall continue in force until terminated in any of the following ways : (a) destruction of the ENC Data; (b) automatically if you fail to comply with any term or condition of this Agreement; and (c) upon expiry of the subscription period or any renewal thereof. Upon such termination, you agree to return the ENC Data to INHO. The right of termination shall be in addition to any other remedies available to INHO. GENERAL - This Agreement shall be governed and interpreted in accordance with the laws of the Republic of INDIA. Failure or delay in enforcing any right or provision of this Agreement shall not be deemed at waiver of such provision or right in respect of any subsequent breach or a continuance of any existing breach. The ENCs on this CD-ROM are encrypted and can be accessed by the specific Electronic Chart Display and Information System (ECDIS) on procuring the license for the requisite ENCs. US (UNITED STATES OF AMERICA) ----------------------------- Only ENCs named using the 'US' prefix are produced by the United States' National Oceanic and Atmospheric Administration (NOAA). NOAA ENCs are provided within this service under the provision of Certified ENC Distributor (CED) status, and therefore when maintained up to date meet US Federal carriage requirements. Permitted Use The NOAA ENCs are intended for navigational use. They are intended to be used in their electronic form only. You may download, use, and redistribute them without restriction, and without payment to NOAA, except as noted herein. They may be used to meet federal chart carriage regulations published in the Code of Federal Regulations. On November 15, 2005, the regulations were as stated below. These regulations may change, and mariners are advised to check the Code of Federal Regulations for their current status. 1) On May 2, 2001, the United States Coast Guard amended the United States chart carriage regulations to permit government vessels to use electronic charting and navigation systems in lieu of paper charts. 2) On July 1, 2002, the International Maritime Organization's (IMO) amendments to chapter V of the International Convention for the Safety of Life at Sea (SOLAS) became effective after being accepted by the Contracting Governments to SOLAS (Jan 2002) and the IMOs Maritime Safety Committee (Dec 2000). These amendments, in part, allowed an electronic chart display system (ECDIS) using ENCs to be accepted as meeting chart carriage requirements of SOLAS chapter V. 3) On August 15, 2002, the United States Coast Guard issued a statement of policy to bring its regulations into agreement with SOLAS Chapter V (as amended by the changes taking effect July 1, 2002). The policy statement said that, if a ship has an approved ECDIS installed according to SOLAS, Chapter V, the ECDIS will be considered as meeting the ship's nautical chart carriage regulations. The ships that are affected are: a) U.S.-flagged ships of 150 or more gross tons that engage on international voyages. b) U.S.-flagged ships certificated solely for service on the Great Lakes and the St. Lawrence River. c) Foreign-flag ships to which SOLAS, Chapter V, applies that are operating on the navigable waters of the United States. This policy is not applicable to U.S.-flag ships engaged only on domestic voyages. These ships must continue to comply with existing navigation equipment requirements until the chart carriage regulations are formally amended. NOAA updates its ENCs for Notice to Mariners on a weekly basis, but the timing of their availability is not guaranteed. Mariners are responsible for ensuring that their ENCs are the most current edition and that the most recent updates have been applied. While NOAA has accuracy standards for each step in the data collection and chart production process, much of the depth information found on NOAA charts is based on surveys conducted before 1940, the shoreline is more than 20 years old, and paper charts used to be compiled manually. Warnings Weekly updates to the ENCs are done on a "best efforts" basis. The timing of their availability is not guaranteed. You are responsible for ensuring that your ENCs are the most current edition and that the most recent updates have been applied.
